New Mexico Has 49 Polio Cases in 1957 Polio struck 49 New Mexicans during 1957 (through November) as compared with 77 stricken over the same period last year. This year's figure was the lowest since 1947. Most paralytic cases were suffered by persons who had not received the Salk vaccine.

The single polio death occurred to a child who had not received the shots. According to officials oft the National Foundation for Infantile Paralysis, the threat of polio remains high, and officials are most concerned with the unvaccinated pre-school and young adult population. New Mexico chapters of the foundation provided care and funds for 477 cases carried over into this year, plus the 49 new cases. Iron lungs, respirators, rocking beds and $10,000 worth of physical therapy equipment were supplied by March of Dimes funds. The physical therapy equipment will be used at the New Mexico Rehabilitation Center now being built on the campus of the University of New Mexico.

M. Laguna Family Takes Mine Suit To High Court Five members of a Laguna Indian family have taken their multi million dollar suit for control of the rich Jackpile Mine to the United States Supreme Court. Members of the Alonzo family, who claim title to the property on which the mine is located, have asked the high court to call up the records in the cease, and review arguments made the case before the Tenth U. S. Circuit Court of Appeals.

The circuit court in its decision upheld Federal. District Judge Waldo Rogers in enjoining all parties to the suit from proceeding further in the Valencia County District Court. A major issue is whether the case can be heard in a state court or whether it must be heard by the federal district court. The Alonzos in their original suit. asked $31 million in damages for ore already extracted at that time by the Anaconda operator of the mine.

They also asked that the Anaconda Co. and Laguna Pueblo be ejected from the property. The title in question is to an area of approximately 50,000 acres known as the Paguate purchase in the northern part of the Laguna reservation. Subsequently, the U. attorney's office has filed an action in federal court here in behalf of Laguna Pueblo to quiet title to the property.

In their appeal to the highest court the Alonzos also object to this procedure on the ground it would change an action at law -with the probability of a jury -to an action in equity with probability of a trial by judge. It is probable that Fred Standley, New Mexico attorney general, also may be drawn into the action before the U. S. Supreme Court. He had argued in the appeal to the circuit court that the federal suit in the case was an arbitrary interference with state rights and that it violates principles of comity between the courts.

Further proceedings in the case, either in federal court or in Valencia County, will await the supreme court's ruling on the Alonzo petition.
